1. HOW TO PARTICIPATE: No purchase, and no entry fee, payment or proof-of-purchase necessary to participate. Sweepstakes starts March 1, 2010 and ends October 30, 2010 (the “Promotion Period”). During the Promotion Period, collect any (3) game pieces from any 20 oz. Mountain Dew®, Diet Mountain Dew®, or 16 oz. AMP ENERGY® beverage and one (1) UPC from any Frito Lay® product. Mail these items to the address on the game piece, and you will receive one (1) T-Shirt. Limit one (1) t-shirt per name and/or household address during the promotional period stated above. Estimated retail value $5.00. Plus, you’ll be automatically entered for the sweepstakes prize. You may also be entered into the sweepstakes prize by mailing (1) game piece to the address on the game piece from any 20 oz Mountain Dew®, Diet Mountain Dew®, or 16 oz AMP ENERGY® beverage. TO ENTER SWEEPSTAKES WITHOUT PURCHASE: Hand print your name, age, complete street address and daytime phone number on the official entry form or on a plain piece of 3” x 5” paper. Mail your completed entry to: North Star Marketing/ Pepsi Fulfillment Center, PO Box 788, Eagle River, WI 54521 postmarked by 10/15/2010 and received by 10/28/2010 to be eligible for sweepstakes drawing. Each entry must be mailed separately in a hand addressed stamped envelope. Limit one (1) entry per stamped outer envelope, per household. Residents of the state of VT may omit return postage. No photocopied or mechanically reproduced entries will be accepted. Pepsi-Cola Company (“Sponsor”) assumes no liability, no responsibility is assumed for lost, late, illegible, incomplete, misdirected or postage-due entries. Entries become the property of Sponsor and will not be returned or acknowledged.
2. PRIZES: One (1) Grand Prize will be awarded, consisting of 2010 Ford Mustang GT vehicle. Estimated retail value $32,000. Winner is solely responsible for all applicable taxes, insurance costs, surcharges, registration, title, and license fees and other costs incurred in claiming, registering or using the vehicle. Vehicle includes standard features; any additional options are winner's responsibility. Color subject to availability and at the sole discretion of the Sponsor. Any vehicle displayed or pictured in promotional/advertising materials may not be the actual vehicle awarded. Winner will be required to personally retrieve the vehicle from a local dealership as determined by Sponsor and may need to provide valid driver's license and proof of insurance/registration. Failure to accept possession of vehicle within thirty (30) days of notification of availability may result in prize forfeiture.
Five (5) Second Prizes will be awarded, consisting of a Gamin nuvi widescreen GPS, Est. retail value $290.00; and Ten (10) Third Prizes will be awarded, consisting of one(1) 1:16 remote control Ford Mustang cars, Est. retail value $30.00. Limit one (1) prize per name and household address.
3. DRAWING: Prize winner(s) will be selected in a random drawing from among all eligible entries received. Drawing will be held on or about 11/7/2010 and will be conducted by representatives of Pepsi Fulfillment Center whose decisions shall be final. Odds of winning depend upon the number of eligible entries received. Prize recipient(s) will be responsible for any tax, title, license, insurance, and registration fees associated with the Prize. The potential Prize winners will be notified by mail within three (3) days of the drawing. Prize winners will be required to sign an Affidavit of Eligibility and Liability/Publicity Release within ten (10) days of notification.
4. ELIGIBILITY: Sweepstakes open to legal US residents, age 18 years of age or older at the time of entry. Employees of Unified Strategies Group, Vend Marketing Institute, Pepsi-Cola Company and its bottlers and all of their respective parents, subsidiaries, divisions, affiliates, suppliers, printers, distributors and advertising, promotional and judging agencies (collectively, “Sponsor and Promotional Parties”) and the immediate family members of such employees and persons living in the same household as such employees are not eligible to win.
5. GENERAL: This game is subject only to the laws of the New York State in the United States. Prizes will be awarded and/or delivered only to addresses within the United States. Unclaimed prizes will not be awarded. Except as determined by Sponsor in its sole discretion, no substitution of prize is offered, no transfer of prize to a third party is permitted and no-cash prizes may not be redeemed for cash value. Void wherever prohibited or restricted by law. Sponsor reserves the right to award a prize of equal or greater value if the published prize is unavailable. Prize recipient will be solely responsible for paying all federal, state and local taxes on prizes; if applicable, winner will receive an IRS Form 1099 for the retail value of the prize. 6. WINNER NOTIFICATION/RELEASE OF LIABILITY: Potential Grand Prize winner will be notified by phone and/or mail within (1) day of the drawing. Grand Prize winner may be required to claim his/her prize within ten (10) days of notification by signing and retuning an Affidavit of Eligibility/Liability Release. In the event (i) any required prize documents are not returned within ten (10) days, if mail is returned to Sponsor as undeliverable mail without a forwarding address, a telephone notification is not confirmed to Sponsor within forty-eight hours, or winner cannot attend on date specified, the prize may be forfeited and an alternate winner may be selected from among all remaining eligible entries. Upon forfeiture no compensation will be given. Grand Prize winner, by acceptance of a prize, agree to release to Sponsor and Promotional Parties, their respective parent, subsidiaries and affiliated companies and their respective shareholders, officers, directors, members, employees, agencies and assigns from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to or from any prize-related activity or any typo-graphical or other error in these Official Rules or in the announcement or offering of any prize.
